De forma majorit\u00e0ria les dones no trobem reconeguda la difer\u00e8ncia sexual, cultural, social per\u00f2 tamb\u00e9 f\u00edsica i biol\u00f2gica. <\/span><\/p>\n<p><!--more--><\/p>\n<p style=\"text-align: left;\"><span style=\"font-family: 'trebuchet ms', geneva; font-size: 10pt;\">En l\u2019\u00e0mbit de la salut laboral, ens trobem amb una manca d\u2019informaci\u00f3 de les treballadores i algunes i alguns professionals per\u00f2, sobretot, amb poca sensibilitat per part d\u2019algunes empreses, la manca de criteris clars que reconeguin les difer\u00e8ncies en els protocols, convenis&#8230; tot plegat acaba vulnerant els dret de les treballadores a la salut.<\/span><\/p>\n<p style=\"text-align: left;\"><span style=\"font-family: trebuchet ms,geneva; font-size: 10pt;\">Cal destacar que la desigualtat en el mercat de treball afecta de ple a la salut de les dones donat que la doble i triple jornada que suportem no es veu reconeguda, per\u00f2 tamb\u00e9 caldria destacar casos espec\u00edfics. Per exemple en l\u2019\u00e0mbit de la viol\u00e8ncia masclista, sigui en l\u2019\u00e0mbit dom\u00e8stic o en el laboral, el quadre de moltes dones que la pateixen sol ser d\u2019ansietat, de nerviosisme, depressi\u00f3.. s\u00f3n s\u00edmptomes que no es reconeixen en la seva globalitat i es tracten per separat. Moltes vegades l\u2019absentisme \u00e9s molt alt i l\u2019impacte sobre les seves condicions de treball, la seva promoci\u00f3 professional o el seu salari \u00e9s directe. Ens trobem davant d\u2019una situaci\u00f3 que nega especificitats i no reconeix o dona com a normals estats de salut o d\u2019\u00e0nim que no ho s\u00f3n gens normals.<\/span><span style=\"font-family: trebuchet ms,geneva; font-size: 10pt;\">&nbsp;<\/span><\/p>\n<p style=\"text-align: left;\"><span style=\"font-family: trebuchet ms,geneva; font-size: 10pt;\">Per altra banda, la manca de diferenciaci\u00f3 entre malaltia i la pr\u00f2pia biologia femenina ens comporta, d\u2019entrada, una discriminaci\u00f3 de base. Les dones que s\u00f3n mares tenen el dret a obtenir el perm\u00eds de maternitat i, en canvi, es parla de baixa maternal i socialment, laboralment i, en molts casos, incl\u00fas sanit\u00e0riament es compta com a tal quan la majoria de dones gaudeixen d\u2019un abona salut per\u00f2 el seu cos necessita recuperaci\u00f3 i els nadons unes cures.<\/span><\/p>\n<p style=\"text-align: left;\"><span style=\"font-family: trebuchet ms,geneva; font-size: 10pt;\">En aquest sentit que voldria destacar una sent\u00e8ncia que ha fet un pas endavant en aquest \u00e0mbit. No hauria de ser una cosa destacable si form\u00e9s part de la normalitat per\u00f2, tristament, la nostra normalitat \u00e9s tota una altra.<\/span><\/p>\n<p style=\"text-align: left;\"><span style=\"font-family: trebuchet ms,geneva; font-size: 10pt;\">Una treballadora de la aerol\u00ednia EasyJet va sol\u00b7licitar el reconeixement d\u2019estar exposada a una situaci\u00f3 de risc durant el per\u00edode de lact\u00e0ncia natural. Per aquest motiu va sol\u00b7licitar la suspensi\u00f3 del contracte de treball i el corresponent subsidi.<\/span><\/p>\n<p style=\"text-align: left;\"><span style=\"font-family: trebuchet ms,geneva; font-size: 10pt;\">La resposta va ser negativa, tan per part de l\u2019aerol\u00ednia , en no tenir contemplat com a risc laboral el per\u00edode de lact\u00e0ncia a l\u2019avaluaci\u00f3 dels riscos, com la m\u00fatua IBERMUTUAMUR que no va considerar justificada l\u2019exist\u00e8ncia de riscos espec\u00edfics per la lact\u00e0ncia.<\/span><\/p>\n<p style=\"text-align: left;\"><span style=\"font-family: trebuchet ms,geneva; font-size: 10pt;\">Despr\u00e9s de dos anys de litigis, i gr\u00e0cies a la Sent\u00e8ncia del Tribunal Suprem es va posar de manifest que quan es realitza l\u2019avaluaci\u00f3 dels riscos s\u2019ha de contemplar la naturalesa, el grau i la duraci\u00f3 d\u2019exposici\u00f3 per part de les treballadores que estan en situaci\u00f3 de lact\u00e0ncia natural als agents, procediments o condicions de treball que puguin influir de forma negativa en la salut de la treballadora o de la o el lactant. En cas afirmatiu l\u2019empresa haur\u00e0 d\u2019evitar a les treballadores aquesta exposici\u00f3 mitjan\u00e7ant l\u2019adaptaci\u00f3 de les condicions de treball.<\/span><span style=\"font-family: trebuchet ms,geneva; font-size: 10pt;\">&nbsp;<\/span><\/p>\n<p style=\"text-align: left;\"><span style=\"font-family: trebuchet ms,geneva; font-size: 10pt;\">Per altra banda, la mateixa sent\u00e8ncia recull que si l\u2019adaptaci\u00f3 no fos possible o la realitzada fos insuficient, la dona gaudeix del dret a un canvi del lloc de treball o b\u00e9 de la funci\u00f3 a desenvolupar.<\/span><span style=\"font-family: trebuchet ms,geneva; font-size: 10pt;\">&nbsp;<\/span><\/p>\n<p style=\"text-align: left;\"><span style=\"font-family: trebuchet ms,geneva; font-size: 10pt;\">Finalment, s\u2019evidenciava el fet que si no \u00e9s possible el canvi de lloc o de funci\u00f3 la soluci\u00f3 vindr\u00e0 amb la destinaci\u00f3 a un lloc malgrat que el mateix no sigui equivalent al seu grup o categoria professional per\u00f2 conservant el muntant retributiu del seu lloc d\u2019origen.<\/span><span style=\"font-family: trebuchet ms,geneva; font-size: 10pt;\">&nbsp;<\/span><\/p>\n<p style=\"text-align: left;\"><span style=\"font-family: trebuchet ms,geneva; font-size: 10pt;\">La conclusi\u00f3 a la que arriba el Tribunal Suprem ve donada perqu\u00e8 els torns i horaris dels vols, respecte a les tripulants de cabina provoca una impossibilitat material de realitzar l\u2019extracci\u00f3 i conservaci\u00f3 de la llet a bord de l\u2019aeronau, la qual cosa havia d\u2019haver estat prevista per l\u2019empresa en l\u2019avaluaci\u00f3 de riscos. Aquesta realitat unida a la manca d\u2019oferiment d\u2019un altre lloc de treball suposa una veritable inactivitat per part de l\u2019empresa en la seva responsabilitat respecte als drets de la treballadora.<\/span><span style=\"font-family: trebuchet ms,geneva; font-size: 10pt;\">&nbsp;<\/span><\/p>\n<p style=\"text-align: left;\"><span style=\"font-family: trebuchet ms,geneva; font-size: 10pt;\">Ens hem de felicitar pel contingut d\u2019aquesta sent\u00e8ncia, potser a partir d\u2019ara es prendran seriosament en consideraci\u00f3 les nostres especificitats en la salut, quan les empreses desenvolupin les avaluacions de riscos laborals. En tot cas, hauria de ser una sent\u00e8ncia de refer\u00e8ncia en les actuacions en l\u2019\u00e0mbit de la salut laboral i crear jurisprud\u00e8ncia que reconegui un dret fonamental: el dret de les dones a viure amb salut.<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>La salut de les dones ja sembla un cl\u00e0ssic dels jutjats i m\u00e9s quan s\u2019avaluen els riscos laborals.
